LEGAL NURSE NEWS: Propecia Class Action Lawsuit

Friday, November 25, 2011

A class action lawsuit has been filed against Merck & Co., Inc. for failing to fully disclose the serious side effects of the prescription drug Propecia. Propecia is a drug designed to reduce hair loss and generate regrowth in most men. Over two-thirds of people worldwide, experience hair loss at some point in their lifetime.

Propecia claims that possible side effects may be a decreased desire for sex, difficulty in achieving an erection and a decrease in the amount of semen. Propecia claims that these side effects occur in less than 2% of their patients and that these side effects go away when men stop taking Propecia. The Connecticut-based law firm filing the lawsuit, claims that the side effects are much more serious than these listed by Propecia, and can be ongoing for years after the customer has stopped taking Propecia. In addition to the side effects being extremely long-lasting, the lawsuit claims that Propecia can be responsible for sexual dysfunction for the plaintiffs, which in many cases, have led to mental and emotional symptoms, including anxiety attacks and insomnia.

The plaintiffs in this case, claim that Propecia has ruined their lives and that the side effects of this drug have proved to cause permanent damage to their bodies. These men claim to be experiencing the same problems up to five years after they stopped taking Propecia. This lawsuit proclaims that one of the plaintiffs had his marriage destroyed, and that his wife had left him, due to these devastating side effects. Another man claims that taking Propecia has disabled his ability to concentrate, hence forcing him to drop out of law school.

This lawsuit claims that Propecia failed to make the necessary changes to its product warning label, which would have made the risks honest and obvious to its users. Propecia has actually changed its warning labels in many European countries and failed to do so in the United States. By doing this, Propecia has knowingly violated the trust of its good-faith consumers. In addition, this lawsuit claims that most of the plaintiffs have been stricken with devastating, irreversible damage. These damages include, but are not limited to, breast enlargement, rash, itching, testicular pain, male breast cancer, and swelling of the lips and face.
